WhatsApp marketing for attorneys is the use of WhatsApp to turn enquiries into instructions and keep existing clients informed, inside three limits: the Legal Practice Council's rules on publicity and touting, the duty of confidentiality, and POPIA section 69. For a law firm it is mostly intake and service messaging, with promotion a narrow, opted-in extra. This post applies our WhatsApp marketing guide for South Africa to a practice where the client's file is the sensitive part.

Four decisions matter: which messages are service and which are promotion, who must speak first, which tool carries client data, and what a written firm policy should say.

The sections below answer each with Meta's own documentation, the WhatsApp Business Messaging Policy and the POPIA material we could verify. The sibling post on WhatsApp marketing for professional services covers the general pattern; law firms differ because the Code of Conduct sits on top of the statute. The same constraints apply to WhatsApp marketing for lawyers and WhatsApp marketing for legal practitioners in any structure, from sole practice to partnership.

Quick Answer

WhatsApp marketing for attorneys works when the client or prospect starts the conversation, replies stay inside the 24-hour window Meta opens, and promotional broadcasts go only to people who opted in. Treat matter updates and document requests as service messages, keep privileged detail off broadcast tools, and write a firm policy before the first message goes out. Use the free Business App for a small practice and move to the Business Platform (API) when you need CRM logging, automation or larger template sends. Since October 2026 Meta also charges for utility templates that used to be free inside the window.

WhatsApp Marketing for Attorneys: What the Rules Leave Open

The rules governing law-firm WhatsApp are the LPC Code of Conduct, POPIA section 69 and Meta's own policy, and none of them bans the channel. They constrain how a practice approaches people and what it does with client information, and each answers a different question.

SourceQuestion it answersWhat it says, as verifiedBest for
LPC Code of Conduct (issued under section 36(1) of the Legal Practice Act 28 of 2014)How may a practitioner publicise services and win work?It addresses publicity and prohibits touting; secondary summaries describe advertising as needing to be informational and not misleadingDeciding whether an approach is acceptable
The Code's confidentiality dutyWhat must you protect? As quoted by a South African law firm, practitioners must "maintain legal practitioner/client privilege and confidentiality regarding the affairs of present or former clients"Deciding what goes over chat
POPIA section 69 and the Information Regulator's direct marketing guidanceWhen may you send electronic promotion?Consent, or the existing-customer exception, with a once-off consent request for non-customersDeciding who receives promotional messages
WhatsApp Business Messaging PolicyWho may you message on the platform?Only people who gave you their number and opted in to receive messages from youKeeping the number from being restricted

We could not extract clause text from the LPC's published Code of Conduct PDF, so we describe it only in general terms and cite no clause numbers. Read the current text, and any guidance from your provincial law society, before approving a campaign. The confidentiality wording comes from a South African law firm's note on WhatsApp and privilege, which concludes that using WhatsApp does not by itself breach privilege where proper safeguards exist.

The practical reading, and it is a reading rather than a ruling: a conversation the prospect starts is the safest footing, an unsolicited approach to a stranger is where POPIA risk concentrates and could be argued to fall within the touting rule (confirm against the Code and your law society), and anything about a client's matter belongs under your confidentiality policy. The rest of this post is built around that line.

Who speaks first decides most of the risk

A prospect who messages your firm first has opened the conversation; replies inside the 24-hour window are service messages. A firm that messages numbers it collected elsewhere faces the WhatsApp opt-in requirement and POPIA section 69, and may raise a touting question under the Code. Plan for inbound, and treat outbound as opted-in only.

Which Client Messages Are Service and Which Are Promotion?

A service message is a free-text reply inside an open window, a utility message is a transactional template, and a marketing message is a promotional template; a law firm's seven typical messages split across all three. Sorting them before you build anything prevents the two common mistakes: putting a sales line into a reminder, and sending promotion to people who never agreed to it.

Meta's pricing documentation defines the template categories this way: marketing messages are promotional templates, utility messages are transactional or informational templates, and service messages are non-template replies. A customer service window opens for 24 hours when the user messages or calls you, and resets when they reply. The table applies those definitions to legal work. Note that since the October 2026 updates, the utility rows carry a per-message charge even inside an open window.

Message to a number the prospect never gave you"We help with accident claims. Call us."Not permitted without opt-inBreaches the WhatsApp opt-in policy and s69, and could be argued to be touting; confirm against the CodeNobody

Treating the second and third rows as operational is a practical reading, not legal advice. The moment a reminder also pitches another service, it becomes promotion in both senses. Keep them in separate messages, and see our guide to WhatsApp message templates for wording that stays in the utility category.

The cost side changed this month. According to Meta's pricing documentation, per-message pricing replaced conversation-based pricing on 1 July 2025, and from 1 October 2026 each business number gets 1,000 free service messages a month, with the October updates also charging for service and utility messages that were previously free. For the utility rows above, that means a charge even inside an open window. We have not printed a Rand per-message rate, because Meta's page does not publish a ZAR card; get a current quote from your provider. Meta's pricing page is the reference.

POPIA section 69 in four lines

Under the Act's text on popia.co.za, electronic direct marketing is prohibited unless the person consented or is your customer under section 69(3). A non-customer may be approached only once, to ask for consent. Every message must identify the sender and give an address to request that messages cease.

Further points come from secondary sources, since we did not retrieve the regulator's own documents. A South African law firm's explainer reports that under the April 2025 amended regulations an opt-out does not count as consent. A review of the Information Regulator's December 2024 guidance reports that consent is the default for electronic marketing, and that legitimate interest cannot replace consent for electronic direct marketing, though it can apply to non-electronic marketing.

Neither source says whether business numbers are treated differently, so a cautious firm assumes no B2B exemption. Enforcement is real: the explainer reports the Regulator's first direct-marketing fine, R100,000 in February 2024, for unsolicited emails sent without consent and ignored opt-outs.

Build the consent record into intake. Our post on WhatsApp opt-in strategies sets out the forms that hold up, and the burden of proving consent sits with the sender.

How Do Prospects Start the Conversation With a Law Firm?

WhatsApp client intake for attorneys starts at inbound entry points, the channels where a prospect taps to message you, so the conversation opens on their initiative. Four fit a practice: a click-to-chat button on the website, the number on your Google Business Profile, a QR code on stationery and in reception, and a Meta advert whose button opens a WhatsApp chat.

The advert route has a pricing advantage. Per Meta's documentation, a message from a click-to-WhatsApp advert opens a free entry point window of up to 7 days in which Meta does not charge for marketing, utility, authentication or service messages. That gives a prospect time to explain a matter and book a consultation before any template charge applies. Our guide to click-to-WhatsApp ads covers the build.

Whether a given advert complies with the Code's publicity rules is a separate question from whether it converts, and it is yours to settle against the current Code. For adverts aimed at people already searching, Google Ads for attorneys feeds the same chat button.

Side calculation: the click is only the first cost

Growth Pulse Media's own SA Digital Cost Index (SADCI) puts the average Meta cost per link click across South African campaigns, not law firms specifically, at R5.12 (US$0.31, converted at the index's R16.42/USD assumption), as at August 2026, roughly 71% lower than the global average. A click is not a conversation. Divide R5.12 by the share of clicks that actually start a chat, then by the share of chats that become instructions, to get your own cost per instruction. Both shares are yours to measure, so treat the average as a planning baseline, not a forecast.

Business App or API: Which Suits a Law Firm?

The WhatsApp Business App is a free app on a single phone number, and the Business Platform (API) is a paid, software-connected service that supports shared inboxes, automation and template sending at scale. The right choice turns on how many fee earners answer, how many people you broadcast to, and whether the number must connect to your practice software.

Newsletter or event broadcasts to opted-in contactsApp for a small list; API once template sends or opt-in records outgrow itPractitioner sources describe app broadcast lists as capped at 256 contacts who have saved your numberFirms with a marketing plan

The 256-contact cap and saved-number requirement come from a practitioner explainer, respond.io's WhatsApp broadcast guide, not from Meta, so confirm them in the app before building a process on them. The side-by-side cost view is in our comparison of Business App vs API.

For a firm, the API choice carries a confidentiality consequence the App does not: a provider sits between you and the client. Meta's platform documentation says messages are protected by Signal protocol encryption before they leave the device and that the Cloud API uses TLS in transit and encryption at rest. It does not say who at the provider can see message content, so ask your provider that question in writing and put a POPIA operator agreement in place before client data flows through it.

What Should a Law Firm's WhatsApp Policy Cover?

A written WhatsApp policy fixes, before the first message, what the firm will and will not do over chat, so individual fee earners do not make confidentiality decisions one text at a time. It does not need to be long; it needs to be specific and applied to every person who touches the number.

  • Numbers: client chats run on the firm's number, not on personal phones; our post on Business App vs personal WhatsApp covers the separation.
  • Content: what detail of a matter may appear in a message, and what only goes by call, meeting or a secured channel. A status prompt that says "please call us" discloses less than a status summary.
  • Documents: which documents the firm accepts on chat, and where they are filed and removed from the phone.
  • Broadcasts: promotion goes only to contacts with a recorded opt-in, and never to a client list assembled for another purpose.
  • Opt-out: the firm honours stop requests promptly and records them. That is the firm's own standard; section 69(4) requires every promotional message to carry an address for requests that messages cease.
  • Provider: the operator agreement and the written answer on message-content access are on file.

That list is a recommended structure, not a requirement either the Code or POPIA spells out. Its value is that each line turns a general duty into a decision someone has made. When the practice grows, the same policy tells new staff how the number works.

Keep promotion and client matters apart

In WhatsApp marketing for attorneys, run promotion and matter communication as two separate streams: opted-in broadcasts for legal updates and events, and one-to-one service messages for live files. Never mention a client's matter in a broadcast, and never add a sales line to a matter update.

Why South African Businesses Choose Growth Pulse Media

Dirk van Greuning built and scaled a large South African ecommerce business before founding Growth Pulse Media, so the paid side is run by an operator, not a copywriter. All work is executed in-house, and the client load is limited so senior attention stays on your account.

For WhatsApp marketing for law firms, the paid work is Meta Ads and Google Ads campaigns that drive enquiries, measured in GA4 and Search Console. The messaging-side offer is set out on our WhatsApp marketing service page. If you want a second opinion first, the audit or consultation is free, with no obligation.

Who This Is NOT For

This approach does not suit firms whose plan depends on reaching people who have not asked to hear from them.

Firms that want to message a purchased or scraped list

If the plan is to WhatsApp numbers you bought or collected for another purpose, the platform's opt-in requirement and POPIA section 69 both stand in the way, and an unsolicited approach could be argued to fall within the Code's touting rule.

Firms that want matter updates sent in full over chat

If the idea is to send case detail through a broadcast tool, settle the confidentiality question and the provider question first. This post does not replace that decision.

Firms that want a legal-compliance sign-off from a marketing agency

We are not a source of legal advice on the Code of Conduct. Whether a given advert or approach is acceptable is a call for your own counsel or your law society.

Frequently Asked Questions

These are the questions law firms most often need answered before sending a first client message: legality, categories, tooling, cost and confidentiality.

Is WhatsApp marketing for attorneys allowed in South Africa?

Nothing we verified bans it, but the Legal Practice Council's Code of Conduct prohibits touting and addresses publicity, and POPIA section 69 governs electronic promotion. The safest pattern is prospect-initiated conversations plus promotion only to opted-in contacts. Check the current Code before approving any campaign.

Is a WhatsApp matter update to a client direct marketing?

As a practical reading, an update about work a client has instructed you on is operational, not promotion. Once the same message pitches another service, it becomes direct marketing and section 69 applies. Keep the two in separate messages.

Do I need the WhatsApp Business API as a law firm?

Not necessarily. The free Business App suits a small practice with one person answering. Several fee earners sharing a number does not automatically mean the API, so check multi-agent options first. Consider the API when chats must be logged to your CRM, when you want automation, or when template sends outgrow app broadcast lists, which a practitioner source describes as capped at 256 contacts.

How much do WhatsApp messages cost a law firm?

The free Business App has no per-message charge. On the Business Platform, Meta moved to per-message pricing on 1 July 2025 and, from 1 October 2026, gives each number 1,000 free service messages a month while also charging for utility messages that used to be free. Meta's page publishes no ZAR rate card, so get a current South African quote from your provider.

Is WhatsApp safe for confidential client information?

Meta says every WhatsApp message is protected by Signal protocol encryption before it leaves the device, and one South African law firm's note concludes that using WhatsApp does not by itself breach privilege where safeguards exist. On the API, a provider sits in the path, so get its access to message content confirmed in writing and sign an operator agreement.
